Please read these Terms of Service (“Terms”) carefully before using the WOM platform. By registering as a merchant or using WOM in any capacity, you agree to be bound by these Terms.
WOM (“we”, “us”, “our”) is a referral management platform based in the United Kingdom. Our platform enables service businesses (“Merchants”) to create branded referral programmes, allowing their customers (“Advocates”) to refer prospective customers (“Leads”).
To register as a Merchant, you must be at least 18 years old and have the authority to enter into contracts on behalf of your business. We reserve the right to decline or terminate accounts that do not meet this criteria.
When you register, you agree to provide accurate, complete, and current information about your business. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Your account must pass verification before your referral page goes live. We may request additional information to verify your business identity. We reserve the right to suspend or terminate accounts that we believe are being used fraudulently or in breach of these Terms.
You agree not to use the Platform to:
You are solely responsible for honouring the rewards you advertise on your referral page. WOM does not facilitate the payment or fulfilment of rewards. Any dispute between a Merchant and an Advocate regarding rewards is entirely between those parties. WOM accepts no liability for unfulfilled reward commitments.
By listing a reward on your page, you are making a representation to Advocates that you intend to fulfil it. Repeated failure to honour rewards may result in account suspension.
WOM operates a consent-first model. When an Advocate submits a referral, the Lead receives an email asking for their consent before their details are shared with you. You must not attempt to contact a Lead whose consent email has not been confirmed, and you must not request or instruct Advocates to bypass this process.
When a Lead grants consent and you accept the referral, you become the data controller for that Lead's personal information. You must handle their data in accordance with applicable data protection law, including GDPR where it applies.
WOM offers paid subscription plans as described on our Pricing page. Prices are shown in your local currency and are exclusive of any applicable taxes unless otherwise noted.
Your free trial period is 30 days from the date of account activation. No credit card is required to start a trial. After the trial period, you must select a paid plan to continue using the Platform. If you do not upgrade, your referral page will be deactivated until a plan is selected.
Subscriptions are billed monthly in advance. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — we do not offer prorated refunds for partial months.
WOM and its associated logos, trademarks, and content are owned by WOM. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You retain ownership of your business name, logo, and any content you upload.
By uploading content to the Platform (including logos and business descriptions), you grant WOM a non-exclusive licence to display that content as part of the service.
To the fullest extent permitted by law, WOM shall not be liable for:
Our total aggregate liability to you under these Terms shall not exceed the total fees paid by you in the 12 months prior to the event giving rise to the claim.
You agree to indemnify and hold harmless WOM and its operators from any claims, losses, or damages (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third party's rights.
We may suspend or terminate your account with immediate effect if we reasonably believe you are in material breach of these Terms, if required to do so by law, or if your account presents a risk to other users or the Platform.
You may close your account at any time by contacting us at hello@usewom.com. On closure, your referral page will be deactivated and your data will be handled in accordance with our Privacy Policy.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time. We will provide reasonable notice of significant changes where possible. Your continued use of the Platform after changes are made constitutes acceptance of the updated Terms.
These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
